Agreement to Terms

By accessing or using VoiceAnswers("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including business customers and their authorized team members.

Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. VoiceAnswers is available only to businesses and individuals located in the United States and Canada. By creating an account, you represent and warrant that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have authority to bind that entity to these terms.

Service Description

VoiceAnswers provides an AI-powered phone answering service for small businesses. The Service answers inbound phone calls using artificial intelligence, conducts conversations with callers, and delivers structured results (orders, appointments, leads, messages) to the business customer via dashboard, SMS, and email.

Emergency Services Limitation

VoiceAnswers is NOT an emergency service and cannot recognize, route, or handle emergency calls (911 or equivalent).

  • The AI cannot detect medical emergencies, safety threats, or urgent situations requiring emergency response
  • You must maintain separate phone lines capable of direct 911 access
  • VoiceAnswers is not liable for any harm, injury, or damages resulting from a caller attempting to report an emergency through the Service
  • Businesses serving healthcare facilities, senior care, or vulnerable populations must implement additional emergency safeguards

Account Responsibilities

  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activity that occurs under your account
  • You must provide accurate business information during setup (menu items, services, hours, pricing)
  • You are responsible for keeping your business information current — the AI responds based on the data you provide
  • You must not use the Service for any unlawful purpose

Acceptable Use

You agree not to:

  • Use the Service to collect credit card numbers or sensitive financial information from callers
  • Disable or circumvent the recording disclosure in two-party consent states
  • Use the Service to provide medical, legal, or financial advice to callers
  • Misrepresent the AI as a human when directly asked by a caller
  • Use the Service for spam, harassment, or any illegal activity
  • Use the Service as a call center, resell minutes, or redistribute the Service to third parties
  • Attempt to reverse-engineer, decompile, or extract the underlying technology of the Service

Call Recording Consent — Your Responsibility

All inbound calls processed through VoiceAnswers are recorded and transcribed when the recording disclosure is active. You (the business customer) are solely responsible for ensuring compliance with all applicable call recording consent laws in your jurisdiction and the jurisdictions of your callers.

In two-party consent states and provinces, the Service automatically plays a recording disclosure at the start of each call. This disclosure cannot be disabled by the business in those jurisdictions. By continuing the call after the disclosure, the caller provides implied consent to recording.

Your obligations include:

  • Understanding and complying with recording consent laws in all jurisdictions where your callers are located
  • Ensuring callers are informed that calls may be recorded and processed by AI
  • Providing alternative contact methods for callers who object to recording
  • Complying with cross-border recording consent requirements if you receive calls from outside your jurisdiction

You agree to indemnify VoiceAnswers from any claims, fines, or damages arising from your failure to obtain proper call recording consent.

Free Trial

The Starter plan includes a free 14-day trial with no credit card required. Each business is entitled to one free trial only, regardless of the number of owners, employees, or representatives. Creating multiple accounts to obtain additional trials is prohibited and may result in immediate termination of all associated accounts.

At the end of the trial, your account will require a paid subscription to continue. If you do not subscribe, call answering will stop but your data will remain accessible for 30 days.

Billing and Payment

Plans are billed monthly and automatically renew at the end of each billing cycle. By subscribing, you provide affirmative consent to automatic renewal at the rate disclosed at the time of purchase. Overage charges are billed at the per-minute rate specified in your plan. You can upgrade, downgrade, or cancel at any time from your dashboard — cancellation is as easy as signup. Changes take effect at the start of your next billing cycle. You are responsible for all applicable taxes.

If payment fails, we will notify you and attempt to collect payment for up to 7 days. If payment remains outstanding after 7 days, we may suspend your account. Accounts suspended for non-payment for more than 30 days may be terminated.

Service Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance. We are not liable for service interruptions caused by third-party providers, network outages, or force majeure events.

AI Limitations

The AI handles calls based on the business information you provide. It does not provide medical, legal, or financial advice. It may occasionally misunderstand callers or handle requests incorrectly. You are responsible for reviewing call results and following up with callers as needed. The Service is not a substitute for professional advice in regulated industries.

The AI performs best with English (North American accents). Other languages, heavy accents, or poor audio quality may reduce accuracy. You must independently verify critical details (appointments, orders, contact information) captured by the AI.

AI Model Training

We do not use your call recordings, transcripts, or structured call data to train AI models. Our provider agreements restrict the use of your data beyond service delivery. You retain full ownership of all input data and AI-generated outputs (call summaries, extracted orders, appointment details) created from your calls.

Intellectual Property

VoiceAnswers retains all rights, title, and interest in the Service, including all software, algorithms, interfaces, and documentation. You receive a limited, non-exclusive, non-transferable license to use the Service during your subscription term.

You retain all rights to your business data and content that you provide to the Service (menus, service lists, hours, pricing, FAQs). By using the Service, you grant us a limited license to use this data solely to operate the Service on your behalf.

Neither party acquires any rights to the other party's intellectual property except as expressly stated in these terms.

Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us an unrestricted, perpetual, royalty-free license to use, modify, and incorporate that feedback without obligation to you.

Data Ownership

You own your business data. Call recordings, transcripts, and structured results generated by the Service from calls to your business are your data. We process this data on your behalf to provide the Service. Upon termination, your data remains accessible through the dashboard and API for 30 days. After 30 days, all data is permanently deleted according to our retention policy. If you need assistance exporting your data during this period, contact support.

Anonymized Data for Service Improvement

We use anonymized, de-identified call interaction data to improve the quality of the AI phone answering service across the platform. "Anonymized" means the following categories of information are removed before any analysis:

  • Names (caller names, business owner names, staff names)
  • Phone numbers
  • Addresses and locations
  • Dates of birth and appointment dates
  • Email addresses
  • Health information (symptoms, conditions, procedures, insurance details)
  • Any other personally identifiable information (PII)

For businesses in sensitive verticals (dental, medical, veterinary), additional scrubbing removes health-related information — including symptoms, procedures, conditions, and insurance details — before any analysis occurs.

No raw call recordings, transcripts, or personal data are shared with third parties for this purpose. The anonymized data is used solely to improve the AI agent's conversation quality.

You may opt out of having your anonymized data included in the service improvement pipeline at any time from your dashboard settings. Opting out does not affect the quality of service you receive.

SMS and Text Messaging

The Service may send SMS messages to callers on your behalf (such as appointment confirmations or order summaries) when you enable this feature. You are responsible for ensuring that your use of SMS messaging complies with applicable laws, including the Telephone Consumer Protection Act (TCPA) in the United States and Canada's Anti-Spam Legislation (CASL).

For Canadian businesses: CASL applies to commercial electronic messages sent via the Service. You must have express or implied consent from recipients, include your business name and contact information, and honor unsubscribe requests within 10 business days.

Callers may opt out of SMS messages at any time by replying STOP. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Consent to receive SMS is not required to use the Service.

Phone Number Assignment

A phone number is assigned to your account during setup. This number is provisioned through our telephony provider and remains active for the duration of your subscription. Upon account termination, the phone number is released after the 30-day grace period. If you need to port your number to another provider before termination, contact support — porting is subject to carrier policies and technical feasibility.

Indemnification

You agree to indemnify, defend, and hold harmless VoiceAnswers, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

  • Your violation of these Terms
  • Inaccurate, incomplete, or outdated business information you provide to the Service
  • Your failure to comply with applicable laws, including call recording consent laws, TCPA, and CASL
  • Claims by callers arising from information the AI provided based on data you supplied
  • Your use of the Service for any prohibited purpose
  • Infringement of any third party's rights by content you provide
  • Your failure to obtain proper consent for call recording or SMS messaging

Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure, or that the AI will handle every call correctly.

Limitation of Liability

To the maximum extent permitted by law, VoiceAnswers is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost business opportunities, or data loss arising from your use of the Service. Our total aggregate liability for any claims arising under these terms is limited to the greater of (a) the amount you paid for the Service in the 12 months preceding the claim, or (b) one hundred dollars ($100).

Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for complying with applicable data protection laws in your jurisdiction, including informing callers about call recording where required.

Termination

You may cancel your account at any time from your dashboard. We may suspend or terminate your account immediately if you violate these terms, engage in fraudulent activity, or fail to pay required fees.

Upon cancellation, a 30-day grace period begins during which your data remains accessible through the dashboard and API. If you need assistance exporting your data during this period, contact support. After 30 days, all call recordings, transcripts, and personal information are permanently deleted. Business account records and billing history are retained for legal compliance.

No refund of prepaid fees will be issued except as required by applicable law.

Dispute Resolution and Governing Law

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Any dispute arising out of or relating to these terms or the Service will first be attempted to be resolved through informal negotiation. If informal resolution fails within 30 days, either party may initiate binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration will be conducted in English and the decision will be final and binding. Either party may bring claims in small claims court if the claim qualifies.

You agree to resolve disputes on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration against VoiceAnswers.

Time Limitation on Claims

Any claim or cause of action arising out of or relating to these terms or the Service must be filed within one (1) year after the claim arose. Claims filed after this period are permanently barred.

Force Majeure

Neither party will be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of government, internet or telecommunications failures, power outages, or pandemics.

Assignment

You may not assign or transfer these terms or your account without our prior written consent. We may assign these terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets, provided the assignee agrees to be bound by these terms.

Severability

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms. If a material change adversely affects your rights, you may terminate your account without penalty within 30 days of the notice.

Entire Agreement

These terms, together with the Privacy Policy and SMS Terms, constitute the entire agreement between you and VoiceAnswers regarding the Service and supersede all prior agreements, understandings, and communications.
